CLIENT AGREEMENT FORM
Please read and agree to the terms by checking the box. There will be a full charge for missed appointments unless twenty-four (24) hours’ notice is received. If you are late for an appointment your training session will be shortened by the amount of time missed. Your trainer will wait 15 minutes for you to arrive, upon which time the session will be considered missed. Classes are non refundable and cannot be used towards any other services unless directed otherwise. After the initial consultation (by email/phone/in person) and first training session, there will be no refunds for cancellations. Please remember that time commitments are being scheduled for you and the necessary arrangements such as training venues, dogs to bring as distractions etc. If you must cancel before your training program has started, or there are extenuating circumstances, a credit will be offered to you so you can begin again when it is convenient. PLEASE READ AND INITIAL THIS CONTRACT CAREFULLY. IT IS REQUIRED THAT YOU UNDERSTAND AND ADHERE TO THE FOLLOWING TERMS AND CONDITIONS OF THIS AGREEMENT. ENROLLMENT: I agree to enroll my dog(s) in the training course and pay the fees indicated by my selection. I understand that the course will be under the direction of Candace Schroer or her staff. I also agree to allow Helping Paws Professional Dog Training and Services and its affiliates to use any photography or video for commercial use. All children under the age of twelve (12) should be under adult supervision and under control at all times. LESSONS: I understand that a) the length of all training sessions can be modified if interrupted by the Trainer depending on the dog’s training level, breed, temperament, and general behaviour. It is also at the Trainer’s discretion to interrupt a lesson if they feel the dog is too stressed, agitated, aggressive or unprepared for the lesson. b) the process of training a dog is not routine. There are many variables that determine the success of a training program; therefore the Trainer will determine the frequency of lessons on a case by case basis, usually 1-2 days a week. I will phone/e-mail my trainer directly to schedule my appointments, and to give twenty-four (24) hours’ notice to cancel if need be. c) THE MOST IMPORTANT FACTOR TO MY ULTIMATE SUCCESS IS HOW WELL I WORK WITH MY DOG(S) BETWEEN LESSONS. FOR THE BEST RESULTS, IT IS IMPERATIVE THAT I WORK WITH MY DOG(S) EVERY DAY AND ATTEND EACH TRAINING SESSION PREPARED AND COMPETENT. CLASSES: The facility that is used to run any class is to be treated with great care. Owners are responsible for their pet at all times. Pets are to be leashed at all times. Do not allow your pet to rome into unotherized areas. The facilities are not owned by Helping Paws. No person or dog is to be in or around any other animal (horse, dog or other). No person or dog is to be in any area that is not being used by Helping Paws for training purposes. WAIVER OF LIABILITY: I recognize that dogs can be unpredictable animals and training is a physical activity and as such, care should be taken to avoid harm to any person, property, or animal. I will assume complete responsibility (during and after the terms of this Agreement) for my own, my family’s, and my dog’s actions and behaviors. a) In consideration for participating in the training I have chosen to hereby release, waive, discharge, and covenant not to sue Helping Paws Professional Dog Training and Services, it’s officers, trainers, servants, agents (herein referred to as Releasees) and hold them harmless from any and all liability, claims, demands, actions, and causes of actions whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, my dog(s), or to any property belonging to me while participating in such training, or while in, on or upon the premises where the training is being conducted or in transportation to and from said premises. b) to the best of my knowledge, my dog(s) and I can fully participate in this training. I am fully aware of risks and hazards connected with the training, including but not limited to the risks as noted herein, and I hereby elect to voluntarily participate in said training and engage in such knowing that the training may be hazardous to me, my family, my dog(s), and my property. I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death that may be sustained by me, my family, my dog(s) or any loss or damage to property owned by me, as a result in being engaged in such training. c) I understand that the Releasees will not be responsible for any medical cost, claims, demands, lawsuits, losses, expenses or costs, including attorney fees associated, with any injury my dog(s), my family, or I may sustain. This Agreement is binding upon Client, spouse of Client, and children of client. This Agreement supersedes all prior discussions, representations, warranties and agreements of the parties, and expresses the entire agreement between Client and Trainer regarding the matters described above. The parties confirm that, except for that which is specifically written in this Agreement, no promises, representations or oral understandings have been made with regard to Dog or anything else. Without limiting the generality of the foregoing, Client acknowledges that Trainer has not represented, promised, guaranteed or warranted that Dog will never bite, that Dog will not be dangerous or vicious in the future, that Dog will not exhibit other behavioural problems, or that the results of the training will last for any particular amount of time. This Agreement may be amended only by a written instrument signed by both Client and Trainer. IN____ AGGRESSION: I hereby waive and release Helping Paws Professional Dog Training and Services from any and all liability of any nature, for injury or damage that me, my dog(s), or guests may suffer, including, but not limited to any injury or damage resulting from the action of my dog, and I expressly assume the risk of any such damage or injury while attending any training session or function of Helping Paws Professional Dog Training and Services, or while on the training grounds or on the surrounding area thereto. I warrant that I have disclosed to the trainer, in writing, any behaviour that may indicate that the dog may be aggressive to other dogs, animals, or people, including but not limited to, growling, forceful barking, snapping, raising of hackles, lowering of head and staring, chasing, attempting to bite, and biting. The trainer reserves the right to refuse or discontinue services for an aggressive dog, in which case the trainer will have no further obligation to the owner. Any further sessions to take place will be refunded or another contract will be negotiated to complete the training program. The owner understands that they have failed to complete the program unless other actions have been taken to resolve any aggression. PAYMENT: All payment is to be made in advance as with other teaching institutions. Cash, E-Transfers or cheque is accepted. Cheques made payable to Candace Schroer. A $50 fee will apply for any non-sufficient funds. Training sessions will not commence until this fee is paid.
